I don't think you can copyright a name, but I do believe he will be entitled to sue the [censored] out of you, I am not sure of the correct criminal terms, but it is all to do with trading under false pretences, and mis-appropriating peoples good names, the same way you couldn't set up a burger chain called MacDonalds, it is illegal to do that sort of stuff.
