CTW Members Bukey Posted May 14, 2003 CTW Members Share Posted May 14, 2003 When it comes to illness, employers are on very dodgy ground... Many people believe that you have to be in a job for 2 or 2.5 years before you get loads of rights, and whilst the case when it comes to some things it's generally a load of bollocks... You have an awful lot of rights from day one. If this is permanant employment, you may find that you are subject to a trial period (usually 3 months) during which either party can give notice (usually a week) for any reason. Check your contract. The only time that they can really sack you with regards to illness (unless it's otherwise in your contract) is if you are skiving... This is gross misconduct. If you're just ill, and they can't prove you're lying, then they are on extremely dodgy ground if they attempt to sack you. The fact that you've got a doc's note proves that you are ill. If you were ill for longer than 3 days (including days you don't work) before the doctors note takes effect then you must also fill in a Self Certificate (available from doctors surgeries, libraries and sometimes your employer). You need to hand that in on your first day back to work. Your employer may require you to have a "back to work interview" - this is nothing to worry about, usually an informal chat, and is pretty common practice - it's not because they don't believe you. Don't know whether this helps or not, but it's how things are... Get better soon! CTW Members Kether Posted May 15, 2003 CTW Members Share Posted May 15, 2003 Employers are more concerned with the number of periods of abscences rather than the number of days off. At my old work I took 3 separate days off in 3 months and got bollocked for it where someone else had more days off over 2 periods and nothing was said. If the working conditions aren't suitable I suggest you get a new job. It may sound [censored] but you've only been there 5 weeks and don't really have a leg to stand on.
