True Alex, but who is "us"?

 

The everyday decent "law abiding citizen" or the criminal.

 

As i serving copper i get nothing but shit off people all day everyday regarding how shit the Police service is, and i'm well fucked off with it, simply because the majority of people haven't got a clue what the Police service is all about and they just jump on the "I hate Police" band wagon.

 

The role of the Police is to investigate crime (by definition) and gather evidence to put before the C.P.S. the C.P.S. then decide what course of action should be taken.

 

I am very sorry for your sis. and what has happened to her. It is not for the Police to decide if she is guilty that is for the court, but by the looks of things she was drunk and she was in charge of the vehicle. The mags can listen to the mitigating circumstances and decide of the action to be taken. She could get a ban, she could also get 10points and a fine. Who knows.

 

If it is found that she was on private property the the C.P.S. (not police) do not have a case, however, if it was in a place where the public have access then they do.

 

I could not give a defininte answer to what i would have done in that situation, but on the evidence given here. I would have probably listened to what your sis had to say. i would have taken her to see you and your old man and weighed it up from there. On the other hand i would not, and no decent copper worth his salt would, have put his or her own livelyhood and future under any risk by taking a total strangers word for it. Surprisingly enough not everyone out there is 100% honest. What if the copper had taken your sis back to the pub and left her with you and your folks, your sis has then left the pub got back in her car and had a single or multiple fatal accident? What happens then?

 

Thats right the Police get serious shit. The copper or coppers who didn't arrest your sis at the first oppertunity, to protect the public and herself from harm, get run for neglegence, lose their jobs, and probably get sent down for Manslaughter.

 

Unfortunately the law is the law, nobody is exempt from it. I'm no angel myself and hold my hands up high to say that i am a daily criminal, I break the speed limit when driving, i use my mobile when driving. And everytime i get caught for these offences i hold my hands up high as i am guilty. As is every other person in this country.

 

By definition she has fully comitted the offence she has been charged for.

furthermore you use a little bit of your police sense to realise that somewhere else in the city, a crime is in progress!

 

Correct me if i'm wrong but being drunk in charge of a vehicle is a crime.

 

Is theft of a 50p can of coke any different from theft of £50,000? NO, its still theft, as in "dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it."

 

Is one crime different to another? In my eyes yes and the penalties prove this in the offences. You get found guilty of the offence in question and you possibly get a ban for 18months and a fine or maybe get the 10 points and the fine. The potential is there to drive a 1 tonne plus piece of metal at speeds well in excess of 100mph (for most cars nowadays) while being pissed. If you had a gun in your possesion in the street you'd do time for it, even if you were sober. Why not for a bigger and more dangerous weapon.

the police ASK her what was going on, if she's too out of it they TAKE HER TO THE STATION and save themselves a SHITLOAD of papework, then get her side of the story the next day.

 

Phil, i think you've been watching too much of the bill! long gone are the days of "what's going on here then?"

If the police have grounds to arrest someone they should do it in the first instance. If they had started to question her about what was going on, that would have been deemed as an interview, without solicitor or legal advice, while in drink, so the evidence would not have stood up in court. A total breach of the Police and Criminal Evidence Act.

 

further to someone else's statement earlier about entitlement to a phone call. This is only allowed if the officer in case and the custody Sergeant agree that the phone call being made isn't to someone who may be implicated in the case.

I can appreciate your points that you made, and value your oppinion if you truly believe in them. unfortunately every point you have tried to get accross has been sensibly answered by intellegent and mature minded members of CTW. Totally agree & as much as sometimes you make me chuckle Phil, there are times you tend to go to far & this is after all serious debates & issues & it is rather annoying when people are trying to discuss things/subjects in an adult fashion only to have wise arse remarks pop up, so can we please all try to keep this on topic & serious.

if you can prove that you aren't going to drive anywhere then you can get off the charge

 

thankfully we have 6 witnesses and email evidence from before the event proving just this

 

her hearing went well, she pleaded not guilty, and our lawyer thinks that we have a very good case due to the evidence we have

 

case is coming up in march, tho the lawyer thinks that the prosecution will call off the case b4 it happens, which is all good news

I was going to post a gag about flagellation, necrophilia and bestiality but it's just flogging a dead horse.

Thing is the police do their job & they get hounded & then in the next breath get hounded for not doing their job, poor fookers & end of the day it is down to the courts etc to decide what happens not the police & the police do not make the law they just try to keep it. bigwink.gif
