basically if the guy had been drivin cautiously he wouldnt have come over a hill into a junction at such speeds that hed hit someone. plus how would he know his light wasnt red already? would have been a hektik stop, and whatever else.

me mam always says if the roads clear and u move out then someone comes from a blind corner and hits you etc then they were drivin too fast basically

You're right Domo, but legaly the presumption is that since it was his right of way I was in the wrong, much like a rear end shunt.

 

But in law all presumptions are rebuttable yet since there were no witnesses I'm stuffed.
