I never knew you wre of a legal background Mr Kether.

 

The thing is tho, if she ain't got no money she won't be able to pay the costs or the backowed rent. She could be declared bankrupt tho...

Sorry to hear Ian !

 

Although I know you have been pretty tense about the whole thing for a while. But when crunch comes to crunch - lines need to be drawn.

 

Maybe this will be a valuable lesson that you have learned, and when taking on something like this again, you should learn about people first before taking people on board again.

Wrong, the losing party would have to pay costs, as they would get a judgement for this. It would be inequitable in any law or the person winning, becaus the other party had behaved in breach of contract to have to cover their own costs.

 

A claim in the small claims court would be the best way forward, but the fact remains, as she doesn't have a job and merely because he gets a judgment in his favour, it does not guarantee he will get any of the monies owed to him.

 

Trust me I'm a lawyer, not meant in a sarcastic way either.
