Legal or Illegal ?

 

And does legal mean only with some kind of annual licence ?

 

(i know nothing in this arena)

Legal as a "random" streaming radio service of mixes if you have a licence from PRS (£3,000/year if I remember rightly)

 

Not sure about the legality of having mixes-on-demand, though. You might want to get in touch with Gurn and see what they say.

to my knowledge, its completely illegal without permission from the artists/labels behind the tracks on the mix.... However, have never heard any label contest an online mix since it is free advertising for their tracks!

 

Might be worth looking into though!

Written permission from the label and consent from the artist i believe, just cause the record label says its ok, doesn;t mean the artist will.

 

Be both contacting the label just be be safe nod.gif

 

I know that if anyone wants to feature one of my choons anywhere, they have to get permission from 'MDC Studios'; and also a written permission from myself as the artist

Thats not true - the artist does not hold the right to the recording once it has been sold to the label.........

check PRS, this is exactly what it does concerning the performance of music, over the net or over the airwaves - all radio stations have to be licenced to broadcast music through PRS.

 

MCPS provides licences where music is available for download. if you're running a site without at least one of these organisations involved, high chance what you're doing is illegal.

 

PPL do not provide licences for internet-only broadcasts, but if you were running a "real" radio station broadcasting on the radio and also by online stream, then you would need a PPL licence.

The reason we got taken down for a week was because we had an mp3 file of a mix by Jon Daniels online and apparently it breeched our terms of contract or something or other....thats why we've changed hosts and also gone down the live365.com route at the moment.

 

Also one of the issues with hosting it yourself would be additional bandwidth.

 

i have thought of a way around the mp3 thing.....you could create a flash file with the mix embedded into the file and us that to play it....but like i say at the end of the day you need a lot of bandwidth for it undecided.gif

when i remixed Rank1 - Airwaves i had to get permission off them and their label, 2 documents one from them personally and one from the label shrug.gif

better safe than sorry.

 

I mean all my tracks have to be sent to my lawyer first, so its bout a week or so before i can release any on the net un stuff, after nearly being sued by Sisqo for producing a full vocal trance remix of 'The Thong Song' i've been really careful, it was released on napster (when it was still going) by mate mate, it was found and they where prepared to take action as well frown.gif

 

so ya people do find out about these things, so its always worth looking into and getting 'written' permission, even if the ppl say its ok, still get it on paper nod.gif

Thats because changing (ie, remix/bootleg) the original sound is one of the biggest breaches of copyright infringement there is...

 

Playing the original released version on a mix will only require permission from the label (as they hold the original recordings rights), although if the tracks had been edited in anyway, then the artists involved would need to be contacted about it.....
