Recently, I have produced a new mix which I have posted on a couple of dance forums for download. I have also put up a tracklisting for it etc.... Today I have had an e-mail from one of the artists featuring on this mix saying that their label will be getting in touch with me about non licensing of their track. This is just a warning to say don't put up tracklistings otherwise you may get an e-mail just like me, this bloody artist was in Mexico aswell, how the f*** he found out about this is beyond me. Either way, I dunno what this world is coming to if this is gonna crop up with every budding DJ out there.

Maybe an idea not to post tracklistings, if peoeple want them, ask them to request via pm thumbsup.gif

well, the tidy boys have gotten shitty before, I guess, like tidy, who are money hungry tongue.gif , if they think a tune of theirs is on a cd, it may make the said person, not buy it as they have it oin cd now, gosh did that make sense??? blink.gif

lol yeah that did make sense thumbsup.gif , but the greedy fuckers should realise that they probably wont get half the sales they if it wasnt for mix cd's IMO. I get through about 3 or 4 mixes a month from mates and Iother people, and I guarantee to hear a track or two on each which I dont have myself, which I then go out and buy.

 

I then give out my mixes to people and the cycle starts over again etc etc

Another thing... a lot of small clubs, dont do PRS.. does that mean that even though the venue has a licence to play music, the dj could still get prosecuted for playing tunes!?

If music is played in a pub/club and they're not paying their PRS fee, then I believe it's the venue that's at fault, not the DJ.

You could be right there andy...I think theres a lot of venues that dont do PRS. I've never filled out one of their forms in my life, and come to think of it I dont know anyone else who has either unsure.gifblink.gif

PRS do actively prosecute venues who don't pay their license fees. However they're more likely to target the bigger venues.

 

The only people who have to 'fill in forms' are the club owners, and of course the artists to whom the royalties are distributed.

oh? my understanding of it was that the DJ had to fill in the form of what has been played, and that got sent off by the venue to PRS to distribute the royalites to the artists from the fees that they've taken... unsure.gif

 

I did read up on it, but was quit a while ago, so i could have got the wrong end of the stick...

You haven't completely got the wrong end of the stick.

 

Because it is not feasible to keep track of every single tune that has ever been played in a club/pub, the PRS use other means to estimate the royalty distributions to each registered artist.

 

For a big club they might request a full tracklisting for 2 or 3 randomly chosen nights of the year, as a representative sample of the music played at that club.

 

For smaller clubs I think they just keep a record of the styles of music played at that club, and use official DJ chart returns as a reference for which tracks are likely to be being played out the most.

 

Either way, it is the responsibility of the owner of the venue to sort this stuff out. Presumably for a big club like the MoS or something, he will have to pester his resident DJs a couple of times a year to get a tracklisting. But in the general case, there's no need to keep a strict record.

 

The only people who have to keep strict records are the biggest radio stations like BBC Radio One, since they have MILLIONS of listeners at any given time, not just a few thousand. They literally inform the PRS of every single track played, so if you get your tune played on Radio One, you are guaranteed a fixed per-minute royalty (in the region of a tenner a minute -- you're laughing if you make it onto their daytime playlist for a few weeks!)

 

Smaller radio stations work more like clubs I presume, i.e. they supply sample playlists as a guideline for what they have been playing.

 

As for membership, well if you are a club/bar/radio station owner, you pay a fee to the PRS which is proportional to the size of your venue and how many events go on, or how many listeners your radio station has.

 

It's a pretty fair system, when you bear in mind that a lot of artists make very little (if anything) out of their actual record sales. At least if your tune is being caned in the clubs, there's a good chance you'll get a proportionate share of the money that the PRS receive.

Yea, Chris is right.

 

We had a big thing on HDUK about this as well...Legally that guy is acting within his rights, because it was unlicenced. Remember, it wasn't just a mix with a few copies given to promoters..it was a link put on the internet for anyone to listen to..it doesn't matter whether it's the full track or not.

 

I don't agree that it should be that way tho, because yea, it is promotion for that artist, but that's the law unfortunately.
